1. Agreement to Terms
By accessing our website at eighty8autocustoms.com or engaging our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
Eighty8 Auto Customs ("we," "us," or "our") reserves the right to modify these terms at any time. We will notify customers of significant changes via email or through our website.
2. Services Provided
Eighty8 Auto Customs specializes in premium automotive customization services, including but not limited to:
- Window tinting (automotive, residential, and commercial)
- Paint Protection Film (PPF) installation
- Vinyl wrap application (full and partial)
- Paint correction and detailing
- Ceramic coating application
- Additional customization services as agreed upon
All services are performed by trained professionals using industry-standard materials and techniques.
3. Quotations and Pricing
All quotations provided are estimates based on the information provided by the customer. Final pricing may vary based on:
- Vehicle condition and preparation requirements
- Unforeseen complications discovered during service
- Changes to the scope of work requested by the customer
- Availability and pricing of materials at time of service
Quotations are valid for 30 days from the date of issue. We reserve the right to adjust pricing if materials costs or other factors change significantly.
4. Booking and Deposits
4.1 Appointment Scheduling
All services require an appointment. Walk-ins may be accommodated based on availability but are not guaranteed.
4.2 Deposit Requirements
A deposit may be required to secure your appointment, typically:
- 50% deposit for full vehicle wraps or comprehensive PPF installations
- 25% deposit for partial services exceeding $1,000
- No deposit required for basic services under $500
4.3 Cancellation Policy
Deposits are refundable under the following conditions:
- Full refund: Cancellation made 7+ days before scheduled appointment
- 50% refund: Cancellation made 3-6 days before scheduled appointment
- No refund: Cancellation made less than 3 days before appointment or no-show
Rescheduling is permitted once without penalty if done at least 48 hours in advance.
5. Payment Terms
Payment is due upon completion of services unless otherwise arranged. We accept:
- Cash
- Credit/Debit cards (Visa, Mastercard, American Express, Discover)
- Digital payments (Venmo, Zelle, Apple Pay)
- Financing options (subject to approval)
Vehicles will not be released until full payment is received. A storage fee of $100 per day may apply for vehicles not picked up within 24 hours of service completion.
6. Warranties and Guarantees
6.1 Workmanship Warranty
We stand behind our work with the following guarantees:
- Window Tinting: Lifetime warranty against bubbling, peeling, discoloration, or delamination due to installation defects
- Paint Protection Film: Manufacturer warranty (typically 5-10 years) plus our installation warranty
- Vinyl Wraps: Installation warranty for adhesion and application quality (typically 1-3 years depending on care)
- Ceramic Coating: Warranty as specified by manufacturer and application protocol
6.2 Warranty Exclusions
Warranties do not cover:
- Damage from accidents, vandalism, or misuse
- Normal wear and tear
- Damage from automatic car washes (for wraps and PPF)
- Improper vehicle maintenance or care
- Modifications or repairs by third parties
- Environmental factors (bird droppings, tree sap, acid rain if not promptly removed)
6.3 Warranty Claims
To make a warranty claim:
- Contact us within 30 days of discovering the issue
- Provide photos and description of the problem
- Allow us to inspect the vehicle
- Follow recommended care and maintenance guidelines
We reserve the right to determine whether an issue is covered under warranty. Our decision will be final.
7. Vehicle Care and Maintenance
To maintain the quality and longevity of our services, customers must:
- Follow all care instructions provided
- Avoid automatic car washes (for wraps, PPF, and ceramic coatings)
- Use pH-neutral cleaning products only
- Avoid pressure washing at close range or high pressure
- Schedule recommended maintenance services
- Promptly address any damage or lifting edges
Failure to follow care instructions may void warranties and guarantees.
8. Limitation of Liability
While we take every precaution to protect your vehicle, customers acknowledge and agree that:
- Eighty8 Auto Customs is not liable for pre-existing paint damage that may be revealed or worsened during film removal or installation
- Some paint systems may be incompatible with certain products, and we cannot guarantee results on all paint types
- Vehicles with previous bodywork, repaints, or poor-quality paint are at higher risk of damage
- Our liability is limited to the cost of the service provided or re-performing the work, at our discretion
- We are not liable for consequential damages, loss of use, or diminished vehicle value
Our maximum liability shall not exceed the amount paid for the specific service in question.
9. Customer Responsibilities
Customers agree to:
- Provide accurate information about their vehicle and its condition
- Disclose any previous accidents, paintwork, or modifications
- Ensure the vehicle is clean and free of personal belongings
- Remove any aftermarket accessories that may interfere with service
- Provide accurate contact information for appointment confirmations
- Review and approve designs, colors, and specifications before work begins
- Make timely payments as agreed
10. Pre-existing Damage
We conduct a thorough inspection of all vehicles before beginning work. Customers will be notified of any pre-existing damage, and we may:
- Document damage with photos and customer acknowledgment
- Recommend repairs before proceeding with certain services
- Refuse service if vehicle condition poses risk to quality or safety
- Adjust quotations based on additional preparation required
Customers are encouraged to inspect their vehicle before drop-off and report any concerns.
11. Intellectual Property
All custom designs, concepts, and creative work produced by Eighty8 Auto Customs remain our intellectual property unless explicitly transferred in writing. We reserve the right to:
- Photograph and document completed work
- Use images for marketing, portfolio, and promotional purposes
- Share work on social media and our website
Customers who prefer not to have their vehicles featured publicly should notify us in writing before service begins.
12. Privacy and Data Protection
We collect and store customer information including:
- Contact details (name, phone, email, address)
- Vehicle information (make, model, year, VIN)
- Service history and preferences
- Payment information (processed securely through third-party providers)
We will never sell or share your personal information with third parties except as required by law or to process payments. Data is stored securely and used solely for business operations and customer service.
13. Dispute Resolution
13.1 Good Faith Resolution
In the event of a dispute, both parties agree to attempt resolution through good faith negotiation before pursuing legal action.
13.2 Mediation
If negotiation fails, disputes may be submitted to mediation through a mutually agreed upon mediator or mediation service.
13.3 Governing Law
These terms are governed by the laws of the State of California. Any legal action must be brought in the courts of Santa Clara County, California.
14. Force Majeure
Eighty8 Auto Customs is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:
- Natural disasters, fires, floods, or severe weather
- Pandemics, epidemics, or public health emergencies
- Supply chain disruptions or material shortages
- Labor disputes or strikes
- Government regulations or restrictions
- Utility failures or equipment breakdowns
In such cases, we will make reasonable efforts to notify customers and reschedule services as soon as possible.
15. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
